1. Acceptance of Terms

By accessing and using Chippendale Carshare's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

Chippendale Carshare operates as a vehicle host on the Turo platform, providing car rental services in Sydney, Australia. Our services are subject to both these Terms of Service and Turo's Terms of Service.

3. Eligibility Requirements

To rent a vehicle from us, you must:

• Be at least 21 years of age (age requirements may vary by vehicle)
• Hold a valid Australian driver's license or equivalent international license
• Have an active Turo account in good standing
• Meet Turo's insurance and verification requirements
• Provide accurate and complete information

4. Booking and Reservations

4.1 Booking Process

All bookings must be made through the Turo platform. By submitting a booking request, you agree to pay all charges associated with your rental.

4.2 Booking Confirmation

Your rental is not confirmed until you receive a confirmation notification from Turo. We reserve the right to decline any booking request.

4.3 Cancellations

Cancellation policies are governed by Turo's cancellation terms. Please review these carefully before booking.

5. Rental Terms

5.1 Vehicle Use

• Vehicles must be used in accordance with Australian road rules
• Smoking and vaping are strictly prohibited in all vehicles
• Pets are not permitted unless explicitly authorized
• Vehicles must not be used for illegal activities
• Off-road driving is prohibited unless the vehicle is specifically designated for such use

5.2 Geographic Restrictions

Vehicles must remain within Australia unless otherwise agreed. Interstate travel may require prior approval.

5.3 Mileage

Daily mileage limits (if any) are specified in your booking details. Excess mileage charges may apply.

6. Payment Terms

6.1 Pricing

All rental rates are displayed in Australian Dollars (AUD) and include GST where applicable.

6.2 Payment Processing

All payments are processed securely through Turo. We do not store your payment information.

6.3 Additional Charges

You may be charged for:

• Late returns
• Cleaning fees (if vehicle is returned excessively dirty)
• Damage or repairs
• Traffic violations or tolls incurred during your rental
• Lost keys or accessories

7. Insurance and Liability

Insurance coverage is provided through Turo's protection plans. You are responsible for selecting appropriate coverage for your rental. Please review Turo's insurance terms carefully.

You are liable for any damage to the vehicle during your rental period that is not covered by insurance, as well as any deductibles that may apply.

8. Vehicle Condition and Inspection

8.1 Pre-Rental Inspection

You should inspect the vehicle before your rental period begins and report any pre-existing damage through the Turo app.

8.2 Return Condition

Vehicles must be returned in the same condition as received, with the same fuel level, and reasonably clean.

8.3 Fuel Policy

All vehicles must be returned with the same fuel level as provided at pickup. Failure to refuel the vehicle will result in charges calculated as follows:

• Missing fuel: $4.00 per litre for the amount of fuel used
• Fail to refuel fee: $10.00 administrative fee

Example: If 15 litres of fuel is missing, the charge will be $70.00 (15L × $4.00 + $10.00 fail to refuel fee), which will be deducted from your security deposit.

9. Prohibited Activities

The following activities are strictly prohibited:

• Subletting or re-renting the vehicle
• Using the vehicle for commercial purposes (e.g., ride-sharing, delivery services) without authorization
• Racing, rally participation, or any competitive driving
• Towing or pushing other vehicles
• Transporting hazardous materials
• Tampering with odometer or vehicle systems
• Allowing unauthorized drivers to operate the vehicle

10. Accidents and Breakdowns

In the event of an accident or breakdown:

• Ensure safety of all parties
• Contact emergency services if necessary
• Report the incident to us and Turo immediately
• Complete all required accident reports
• Do not admit fault or liability
• Cooperate fully with insurance investigations

11. Modifications and Extensions

All rental modifications and extensions must be requested and approved through the Turo platform. Unauthorized extensions may result in additional charges and penalties.

12. Termination of Rental

We reserve the right to terminate your rental immediately if you:

• Violate any terms of this agreement
• Use the vehicle for illegal purposes
• Provide false information
• Fail to make required payments
• Endanger the vehicle or others

13. Limitation of Liability

To the maximum extent permitted by law, Chippendale Carshare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

14. Indemnification

You agree to indemnify and hold harmless Chippendale Carshare from any claims, damages, losses, or expenses arising from your use of our vehicles or violation of these terms.

15. Dispute Resolution

Any disputes arising from these terms shall be governed by the laws of New South Wales, Australia. We encourage informal resolution of disputes before pursuing legal action.

16. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of modified terms.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
